MOTORCYCLE ACCIDENTS
INJURY AND WRONGFUL DEATH

With gas prices soaring, motorcycles, scooters and mopeds are popular modes of transportation.  Though estimated sales of motorcycles are up appreciably, one disturbing fact remains. According to the 2010 Governors Highway Safety Report, motorcycle passenger helmet usage has dropped by as much as 16% from recent years.

The National Highway Safety Traffic Safety Administration estimates motorcycle drivers are 35-times more likely to be killed in accidents than automobile drivers. Even safe drivers can become victims of terrible accidents due to a defective product.

Our client, Tom Wenning, Portland, Oregon, lost his leg in a motorcycle accident that was determined to be caused by a defective part. Here, he is pictured prior to the accident.

Many motorcycle riders enjoy adding fancy, upscale “after-market” products to their bikes. Unfortunately, one Sunday afternoon motorcycle ride turned tragic for a D'Amore Law Group client who was seriously injured as the result of a defective after-market motorcycle part.

The longtime Portland motorcycle rider purchased – and professionally installed – a  beautiful, new exhaust pipe with scalloped edges made specifically for his type and model of bike. As the rider turned into a curve, the pipe hit the pavement and threw the bike and rider across the pavement and down a cliff. The rider lost his leg above the knee. A thorough investigation proved what caused the accident – the after-market exhaust pipe was defective. Oregon attorney Tom D’Amore successfully negotiated a settlement with the national company that manufactured the defective product.
